Terms of Use – M-KART App

1. Scope

These terms of use apply to the mobile application M-KART (available for iOS and Android). The separate imprint and privacy information applies to our website; the privacy policy of the M-KART app additionally applies to the app. The M-KART app is a professional application (B2B) for employees of companies that use M-KART; it is not intended for consumers or children.

3. Description of the service

M-KART is the mobile companion to the M-KART server that the deploying company operates itself (on-premises). The app connects to this server and makes its order, fault, ticket, time-tracking, material and asset data available on mobile devices and – for the most recently synchronized content – also offline. Access requires a valid user account created by the administrator of the deploying company; self-registration is not available.

4. User accounts and right of use

Access credentials are personal and must not be passed on to third parties. The app may only be used within the scope of the employment or contractor relationship with the deploying company. The deploying company is responsible for the accuracy and maintenance of the business data processed via the user account.

5. Subscriptions, trial period and cancellation

Certain feature sets of the app are offered for single-user operation as an automatically renewing subscription via the App Store (Apple) or Google Play, initially with a free trial period. The price, term and renewal interval of the respective subscription are shown in the relevant store before purchase; the information shown there is binding.

Unless canceled at least 24 hours before the end of the current period, a subscription renews automatically at the price applicable at that time. Payment and billing are handled exclusively via the payment method linked to the store account; cancellation is made via the account settings of the respective store (App Store or Google Play), not within the app. Billing periods that have already started are not refunded pro rata upon cancellation, to the extent permitted by law.

For companies that use M-KART under an existing license or service agreement with AUPOS IQ GmbH, the terms agreed there take precedence.

6. Availability and liability

We endeavor to keep the app functional but cannot guarantee uninterrupted availability, in particular because the app depends on the server operated by the deploying company itself. We are liable without limitation for damage caused intentionally or through gross negligence and in accordance with the mandatory provisions of the Produkthaftungsgesetz (German Product Liability Act). Otherwise, we are only liable for breaches of material contractual obligations, limited to the damage typically foreseeable under the contract.

7. Changes to the app and to these terms

We continuously develop M-KART and may adapt, extend or discontinue functions. We will amend these terms of use if the app's functions or the legal situation change; the current version is always available at this address.

9. Governing law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory statutory consumer protection provisions provide otherwise.
